Terms of Service & Break Rules

1. Who we are & where breaks happen

Let It Fly Breaks ("we," "us") operates live sports-card group breaks and related sales. Breaks are conducted live on Whatnot; purchases of break spots are transactions processed by Whatnot and are additionally governed by Whatnot's Terms of Service, Card Breaks Policy, Surprise Sets Policy, and Buyer Protection Policy. Where those policies conflict with these terms for an on-platform purchase, Whatnot's policies control.

2. Eligibility

This site and our breaks are intended for users who are at least 18 years old. Persons under 18 may not purchase, participate, or register.

3. What a break is

A group break splits the contents of sealed product (or, for known-card boards, a fully disclosed set of cards) among multiple buyers by team, spot, or draft position. When your spot hits, you receive every card allocated to your spot under the posted format rules for that break. Sealed product is sealed: it is possible for a spot to receive few cards, no "hits," or no cards at all. That is the nature of group breaks and part of what you accept when purchasing a spot.

4. How we describe card values ("comps")

Where we reference a card's value, we mean its recent verified sold price ("comp") from public marketplaces and pricing tools (e.g., eBay sold listings, 130point, Card Ladder) as of the time we build the board or listing. Comps are informational references, not appraisals, promises, or guarantees of present or future market value. Card values fluctuate, sometimes sharply. Nothing we sell is an investment, and no statement on this site or on stream guarantees resale value. Descriptions of our board-building standards refer to how we select inventory, not to a promised outcome of any purchase.

5. Break rules (the House Rules, formalized)

• Published boards. For known-card boards, the full set of included cards is disclosed before spots are sold, consistent with Whatnot's Surprise Sets requirements.
• Fixed pricing. Posted board prices do not change after posting.
• Randomization. Random assignment always happens live, on camera, in full view of the stream. For hobby-box and wax breaks, random assignment runs through Whatnot's built-in randomizer. For repack breaks, we use the established break-industry team-deck method: a full deck of team cards is shown to camera, shuffled on camera, and drawn live to assign spots. We never use wheels, raffle drums, or other mechanical randomizers, and no assignment ever occurs off camera.
• Filled breaks run. We do not cancel a filled break.
• Unfilled breaks. If a break does not fill within 7 days of listing (or by its scheduled run time, whichever is later), it is cancelled and all spots are refunded through the platform — unless the listing posts a specific fill deadline, in which case that date controls.
• Live comps & buyback. Every hit pulled on stream is comped live against recent verified sold prices. The winner may elect to sell the card back to us on the spot at 80% of the live comp. [Buyback mechanics subject to attorney review.]
• Related parties. If any founder, employee, or household member of Let It Fly Breaks purchases into a break, that relationship is disclosed on stream before the rip.
• Multi-team / miscellaneous cards. Allocation rules for multi-team cards are stated in the break listing; where randomized, the in-app randomizer is used.

5b. Website presale boards

Some breaks are sold directly on letitflybreaks.com as presale boards. For those: you add spots to your cart and pay by card at checkout (processed by Shopify); your spot locks the moment payment completes. Shipping and applicable sales tax are calculated and charged at checkout. Cancellation is free any time before the board fills — email breaks@letitflybreaks.com. Every presale board posts a fill deadline — if the board does not fill by that date, every order is refunded in full to the original payment method within 5 business days. Once a board fills, all sales are final and the break runs as scheduled, live on camera, with the full VOD archived.

6. Repack products

Repack breaks use professionally sealed products from manufacturers authorized under Whatnot's Professionally Sealed Surprise Products policy, including Enigma Trading Co. We are the seller, not the manufacturer, of these products. Series-level checklists are published by the manufacturer as required by platform policy, and each repack break listing identifies the product line being opened. Manufacturer buyback or guarantee programs, where offered, are the manufacturer's programs and subject to their terms.

7. Cancellations & refunds

• All break sales are final once the break begins. Requests to cancel a spot must be made before the break starts and are handled through the platform's cancellation flow.
• Once product is opened on stream, no refunds or returns are available for break purchases, except as provided by Whatnot's Buyer Protection Policy.
• For sports cards purchased on Whatnot, buyer-protection claims must generally be submitted by the earlier of 7 days from delivery or 30 days from purchase; break items are eligible only if missing, delayed, incorrect, or damaged, per Whatnot policy.

8. Shipping

• Hits ship sleeved and toploaded the next business day after the break.
• Hits ship. On sealed hobby-box breaks (website presale boards), base cards are not shipped. If your spot yields no hits, you will not receive a shipment and your shipping charge is refunded to the original payment method. Repack breaks on Whatnot are unaffected — every repack box contains a card, and every purchased box ships its card.
• Shipping and delivery issues for on-platform purchases are handled through Whatnot's shipping and buyer-protection processes. We are not responsible for carrier loss, damage, or theft after delivery, except as platform policy provides.

9. The buylist (selling cards to us)

• We buy cards at 80–95% of value depending on the card and condition. Individual card value must exceed $100. Quotes are based on recent verified comps and photographs you provide; a quote is valid for 7 days and may be revised after physical inspection if the card materially differs from the photos or description.
• You must own the cards you submit, free of any lien or claim, and be 18+.
• If we decline a card after inspection, or you decline our revised offer, we return it at our expense.
• Payment is sent the same business day your cards arrive and pass inspection in the condition stated in your submission. We do not pay for cards before receiving them.
• Cards in our custody are handled with commercially reasonable care; our liability for loss or damage while in custody is limited to the quoted amount for the affected card(s).

10. Consignment

• As an alternative to the buylist, you may consign cards to us. Your payout is fixed at intake at 100% of the card's recent verified sold comp (comp source and date recorded at acceptance).
• Consigned cards are auctioned live on stream within 60 days of our receipt and inspection. Payment of your fixed payout is sent within 5 business days of the auction in which your card sells.
• Cards must arrive in the condition stated in your submission; payouts may be revised or cards returned (at our expense) if condition materially differs on inspection.
• We control auction timing, stream placement, and format. If we fail to auction your card within 60 days of receipt, you may elect return of the card or the fixed payout.
• Our liability for loss or damage while consigned cards are in our custody is limited to the fixed payout amount.

11. Giveaways

Free giveaways are follower-based or otherwise free to enter; no purchase is ever necessary to enter or win, and a purchase does not improve odds. Giveaway draws run on camera. Full official rules for any promotion are posted at Giveaway Official Rules.

12. Stream conduct

We do not tolerate hate speech, harassment, or discrimination in chat or on stream. Breakers and moderators may time out or ban participants at their discretion.

13. Disclaimers & limitation of liability

THE SITE AND OUR SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, AND OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM A PURCHASE IS LIMITED TO THE AMOUNT YOU PAID FOR THAT PURCHASE. NOTHING IN THESE TERMS LIMITS RIGHTS THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.

14. Governing law & disputes

These terms are governed by the laws of the State of Illinois, without regard to conflict-of-law rules. Any dispute that cannot be resolved informally shall be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, held in McHenry County, Illinois or conducted remotely at your election. You and we each waive the right to a jury trial and to participate in a class action. Either party may instead bring an individual claim in small-claims court. You may opt out of this arbitration provision by emailing breaks@letitflybreaks.com within 30 days of your first purchase. "We," "us," and "Let It Fly Breaks" mean Let It Fly Breaks LLC, an Illinois limited liability company. Disputes arising from purchases made on Whatnot are additionally subject to Whatnot's own terms and dispute processes.

15. Changes

We may update these terms; the "last updated" date will change and material changes will be announced on stream or by text/email to Flight Club members.
